TOWN OF YARMOUTH
BOARD OF APPEALS
MEMORANDUM TO FILE
PETITION 5245
September 9, 2026
MEMBERS SITTING (August 27, 2026 hearing): Chairman Sean Igoe, Dick Martin, Barbara
Murphy, Anthony Panebianco and Richard Neitz
PETITION 5245: Angelo and Michelle Caputo. 81 Standish Way, West Yarmouth, MA. Map & Lot
#: 29.160; Zoning District: R-25. The Applicant seeks a Special Permit per §401.1.2 to park a boat to the
front of the front building line of the lot. The Applicant requests a waiver from the requirement for a
certified site/plot plan less than two years old.
On February 22, 2024, a Violation Notice was issued to the petitioner for storing a boat in front of the
front building line of the lot.
Subsequently, the Yarmouth Zoning Bylaw was amended through November 17, 2025. Per Section
401.1.2 of the amended bylaw, due to a unique condition or features of the parcel, the Board may grant a
Special Permit to park a boat to the front of the front building line of the lot, with specific conditions,
including: Boat shall be parked in the driveway of a residential parcel without creating a traffic or fire
safety issue, and adequate remaining on -site parking for the property can be demonstrated.
Angelo and Michelle Caputo appeared at the August 27, 2026 hearing to seek relief to park a 20-foot boat
in the driveway of the property. The lot contains —5,227 square feet of area. The petitioner's testimony
confirmed the Assessor's Property Card listing of three bedrooms, specifically two bedrooms on the
second floor and a first -floor study that functions as a bedroom.
Prior to the hearing, two abutters submitted letters of opposition with concerns about safety.
Based on photos provided by an abutter and a site visit by a Board Member, it appears that at least five
cars are parked at the property: two cars in the driveway and three cars on the street.
The Board opposed granting relief to park a boat in the driveway, which would further reduce available
parking on a lot that already lacks sufficient space for its existing vehicles, and would compromise traffic
and fire safety, both on the property and at the intersection of Webster Road and Standish Way.
Without support for the petition, Chairman Igoe presented the options to the petitioner. Subsequently, the
petitioner requested to withdraw the petition without prejudice.
A motion was made by Mr. Martin and seconded by Mr. Panebianco to allow the petitioner to withdraw
the petition without prejudice. The members voted as follows: Mr. Martin -AYE; Mr. Neitz-AYE; Ms.
Murphy -AYE; Mr. Panebianco-AYE; Chairman Igoe -AYE. The motion was voted 5-0 in favor.
Therefore, the petition was withdrawn without prejudice.
Sean Igoe, Chairman
