Current Visual Signs commercial storefront • 11 North Main Street. South Yarmouth Prepared for Zoning Board of Appeals Hearing - August 2026 Visual Signs Cape Cod - Yarmouth ZBA Hearing Package ;: v;f.. 1 1. Executive Summary This appeal arises from a November 2024 zoning complaint and violation notice alleging that Visual Signs Cape Cod was operating a graphic vehicle-wrap/sign business from the residence at 140 Cranberry Lane. The Town's original materials referenced activity in the garage, vehicles at the property, and an online business listing that identified the residential address. The circumstances presented to the Board today are materially different. Visual Signs now maintains a separate commercial storefront at 11 North Main Street in South Yarmouth. The storefront contains the reception/customer area, administrative workspace, production equipment, printerslcutters, vinyl and material inventory, and apparel operations. Current public -facing advertising directs customers to that commercial address. The applicant is not asking the Board to authorize a full commercial sign shop at the residence. The requested relief is narrow: permission to use the existing garage for limited application of vinyl/decals to vehicles, while the primary business, customer -facing, administrative and production functions remain at the separate commercial location. The applicant respectfully asks the Board to evaluate the present use and the requested limited relief based on the current conditions, rather than the broader business operation depicted in the 2024 complaint materials. Key facts for the Board Business appeared to operate from 140 Cranberry Lane. Garage depicted as sign/wrap production workspace Online listing showed 140 Cranberry Lane. Concern about neighborhood commercialization Visual Signs now has a dedicated commercial storefront at 11 North Main Street. Current garage photographs show the production equipment removed and the space substantially open. Current Google listing and website direct the public to 11 North Main Street_ Requested residential activity is limited; the property is intended to remain visually residential. Visual Signs Cape Cod - Yarmouth ZBA Hearing Package 2. Yarmouth Zoning Framework - Home Occupations The current Yarmouth Zoning Bylaw is important because it does not treat every business -related activity at a residence as categorically forbidden. Section 202.5 lists 07 Home Occupations as an allowed use in residential districts, subject to Footnote 50 and the criteria of Section 416. Section 416.1 - Goals & Obiectives The bylaw expressly states that its purpose is to allow residents to conduct small business activities from their homes while protecting and maintaining the residential character of established neighborhoods, buildings and adjacent properties. It further describes home occupation as an incubator from which small businesses may grow and expand into Yarmouth's designated business districts. That policy is directly relevant here. Visual Signs has in fact expanded into a separate commercial storefront. The remaining request at 140 Cranberry Lane is for a much narrower activity than the full commercial operation. Section 416.2 - Residential -character safeguards The bylaw's structure focuses on keeping the home looking and functioning primarily as a residence. Among its safeguards: the home occupation must be incidental and secondary to residential use; activity must be indoors; exterior business displays/signage are prohibited; traffic and parking impacts are restricted; objectionable noise, fumes, vibration and similar impacts are prohibited; and the premises must remain identifiable as a residential dwelling. Important distinction for this appeal: Section 416 contains strict by -right limits, including a 250-square-foot cap and restrictions on clients/customers. The requested vehicle -decal activity may not fit every by -right criterion. Therefore, this package does not claim that Section 416 automatically authorizes the requested activity. Instead, Section 416 demonstrates the Town's underlying zoning policy: limited business activity at a residence can be compatible with residential zoning when neighborhood character and impacts are carefully controlled. The Board is being asked to grant the specific relief identified in the filed appeal, with reasonable conditions if appropriate. Section 103.2.2 - Special Permit criteria The current bylaw also uses neighborhood -impact criteria for special permits; no undue nuisance, hazard or congestion, and no substantial harm to the established or future character of the neighborhood or Town. Section 103.2.4 permits reasonable conditions, regulations or limitations to serve the purposes of the bylaw. Section 202.5 classifications The current Use Regulation Table separately identifies K3 as 'Mailing, reproduction, commercial art & stenographic services' and L5 as 'Other auto services.` The 2024 violation notice characterized the alleged use as L5. The filed appeal identifies K3 relief. The applicant asks the Board to consider the actual, limited activity proposed - applying vinyl/decals - and the current operational facts rather than treating the residence as the location of a full auto -service or full sign -production business. Proposed Operating Commitments To reinforce the limited nature of the requested relief and protect the residential character of 140 Cranberry Lane, the applicant is prepared to accept reasonable conditions consistent with the Board's authority and the intent of the zoning bylaw. Primary business location remains 11 North Main Street. No exterior business signage or advertising at 140 Cranberry Lane. No outdoor vinyl installation, production, display or business storage. No large -format printing/production equipment returned to the residence Vehicle decal/wrap application only within the existing garage. No mechanical repair, body work, painting or conventional auto -service activity. No unreasonable noise, fumes, glare, vibration or other nuisance. Customer -facing consultations, design, printing, sales and ordinary business administration remain at the commercial storefront. Keeps the residence secondary to the commercial operation. Preserves the residential appearance. Keeps business activity inside the garage. Keeps production at the commercial shop. Narrowly defines the requested activity. Distinguishes the requested use from an auto repairlservice shop. Protects abutters and neighborhood character. Directs the public and primary operations away from the residence. These commitments can be refined by the Board. They are offered to make clear that the applicant is seeking a controlled, limited use - not authorization to re-establish the former full sign -shop operation at the residence. The applicant is prepared to maintain no exterior business signage, display or other visible commercial identification at the residence. The proposed activity is limited to applying vinylidecals; no mechanical repair, body work or painting is requested. The filed appeal identifies K3 relief and asks the Board to evaluate the actual proposed activity. Visual Signs Cape Cod - Yarmoulh ZBA Hearing Package Page 1i 12. Requested Relief and Closing Statement Visual Signs respectfully requests that the Zoning Board of Appeals grant the relief identified in the filed application so that the existing garage at 140 Cranberry Lane may be used for the limited application of vinylldecals to vehicles, subject to reasonable conditions the Board finds appropriate. The applicant's position is not that a residential property should become a commercial storefront. The opposite is reflected in the current Yarmouth Home Occupation bylaw: the Town expressly recognizes limited small-business activity at residences while requiring that residential character be protected. Visual Signs has moved its primary operation into a designated commercial location and asks the Board to allow only a narrow residual activity at the home. The evidence in this package demonstrates: 1. The original 2024 concerns have been materially addressed. 2 The primary business has a real, dedicated commercial storefront. 3. Production equipment and ordinary commercial operations have moved to that storefront. 4 Current advertising directs customers to the commercial address. 5. The residence can remain visually and functionally residential. 6. The requested garage activity can be narrowly defined and conditioned to protect the neighborhood Respectfully requested: approval of the limited relief sought in the application, with reasonable conditions preserving the residential character of 140 Cranberry Lane.
