I. Statement of Findings Under Municipal Wetlands Bylaw:Yarmouth Wetland Bylaw,Chapter 143' 1 'The project has been denied under the Yarmouth Wetland Bylaw Chapter 143 and approved under the MA Wetlands Protection Act 310 CMR 10.The Conservation Commission held a vote for each decision at the public hearing on 9/17/2026. The Conservation Commission decided that proposed work cannot be conditioned to meet the standards set forth in the Yarmouth Wetland Protection Regulations;specifically,Section 3.01(2),3.01(12a),3.01(12c),and 3.01(12d)as discussed below 3.01 (2)of the Yarmouth Wetland Protection Regulations provides: New and rebuilt piers shall be constructed to minimize the blocking of sunlight to shellfish beds and grasses.Piers shall have planks running across the width with minimum spaces of 1 inch between planks.Alternative materials that maximize light penetration, such as grated decking, may also be used.Piers will be a maximum of 4 feet wide, measured inside pile to inside pile for regular docks, and measured by deck width for monopole docks. The seaward side of the proposed dock is proposed at 16 feet wide, exceeding the maximum width.Approval would require a variance to the regulations. 3.01 (12)provides: New proposed docks, piers and floats(as defined in these regulations)will not be allowed within: (a) 75 feet, of adjacent docks, piers and floats, with the exception marinas. (b) 100 feet, of a navigable channel or boat mooring. (c)250 feet, from a public boat ramp, public landing,or public swimming beach. (d)No new pier or float system shall be located closer at any point than 25 feet to a property line, except, for a pier jointly owned and used by 2 or more contiguous shorefront properties, or written permission from the abutters is obtained in order to minimize environmental impacts such as the need for dredging. The 25 foot setback shall be measured from the outermost property lines of the applicable properties. (a)A dock was approved at 104 River Street(SE83-2429)and has not yet been constructed. The permitted footprint of the dock is 27 feet away from the proposed dock. The dock to the south at 110 River Street is shown on the plan as being 68 feet away, but the associated float is not shown, and is located even closer.Approval would require a variance to the regulations since 75 feet is not provided between piers. C)The proposed dock is located within 250 feet of a public beach, since Windmill Beach is 190' away.Approval would require a variance to the regulations. (d)The proposed dock spans the property line between 104 and 110 River Street.Written permission was not obtained from the property owners.Written opposition was received from the owner of 110 River Street. The application did not include any mention of joint-use of the pier, and if it was intended, the applicant and easement holders are not contiguous shorefront property owners.Approval would require a variance to the regulations. Section 2.05(1)h requires review from the Yarmouth Waterways/Shellfish Advisory Committee for all coastal proposals including docks to ensure there are no issues concerning navigation and shellfish. (h) Coastal projects that will take place below Mean High Water such as, but not limited to, docks, piers, bulkheads, revetments, dredging, and boardwalks require review at a Yarmouth Waterways/Shellfish Advisory Committee hearing. To the extent practicable, this shall take place prior to the Conservation hearing. The Notice of Intent, Page 7a of 9 *ELECTRONIC COPY Town of Yarmouth Wetland Bylaw Chapter 143 083-2516 Applicant: J.Scott Martin,JSM Realty Trust:Resident of 6 Willow Lane Project Location: 104& 110 River Street plans, and supplemental information must be submitted to the Division of Natural Resources office both by email and certified mail(or hand delivery)according to their filing requirements. The applicant must provide the Conservation office proof of submission and the scheduled Waterways/Shellfish Advisory Committee hearing date at the time of filing The Waterways/Shellfish Advisory Committee reviewed this project at four public hearings beginning on April 9,2026,and voiced concern about the potential negative impacts on navigation from the proposed project causing congestion in the small area and its proximity to the channel. In their opinion, the addition of another dock would cause more congestion and could be a hazard to safe navigation. The Committee voted 3-0 to NOT recommend the project at their final hearing on this project due to an impediment to navigation on August 13,2026. H. Yarmouth Conservation Commission Determinations: As noted above, the project does not comply with the standards set forth in the Yarmouth Wetland Protection Regulations, Section 3.01(2),3.01(12a),3.01(12c),and 3.01(12d),does have the ability to grant waivers. Section 7.01 of the Yarmouth Wetland Protection Regulations provides: (1) The Conservation Commission may, at its discretion, waive one or more of the specific stipulations or requirements of one or more of these Regulations in rare or unusual cases. Variances shall be considered on a case-by-case basis and shall not set precedent for future Variance requests. (2) Criteria A variance may be granted only for the following reasons and under the following conditions:a)when the proposed work represents a significant ecological improvement when compared to existing conditions b)when the proposed work will not adversely affect any resource area(s)or value(s)subject to the protection of these regulations c)when there is an overriding public benefit or safety issue at hand d)and there is no feasible alternative to the proposed work as determined by the Conservation Commission e)Mitigation is provided by the Applicant that will allow the project to be conditioned to contribute to the protection of the Resource areas The applicant failed to follow the procedure outlined in 7.01 to request a variance, which includes an alternatives analysis. When the incomplete application was brought up during the hearing and the applicant's representative was given the opportunity to continue the hearing to provide revised materials to fulfil the minimum standards, including an alternatives analysis,he declined. Upon careful consideration of the evidence and testimony at the public hearing, the Commission finds that the applicant has provided no evidence or argument that the project poses a significant ecological improvement when compared to existing conditions,or will not adversely affect any areas subject to the protection of these regulations. The applicant has provided no evidence or argument that there is an overriding public benefit or safety issue at hand and there is no feasible alternative to the proposed work. Accordingly, there is no basis, let alone a compelling one,to justify the Commission's exercising its discretion to grant waivers. The application is simply noncompliant, and there is no basis to relieve the applicant from meeting the requirements of the Town. III. Yarmouth Conservation Commission Decision: Due to the project's failure to satisfy Sections 3.01(2),3.01(12a),3.01(12c),and 3.01(12d),the negative recommendation from the Waterways/Shellfish Advisory Committee due to an impediment to navigation, and failure to submit a complete application, the Yarmouth Conservation Commission voted unanimously on 9/17/2026 to deny the application under the Yarmouth Wetland Bylaw,Chapter 143.
