BOARD OF HEALTH
To: Board of Appeals
From: Bruce G. Murphy, MPH, Health Agent
Date: November 29, 1994
Subject: Appeal #3149 and #3154
Blue Water Resort and Edge of the Sea Motels
I have reviewed the file, a letter from Howard Wensley received November 28,
1994, and the applicant's petition for the Blue Water Resort Motel and have
the following concerns and comments.
1. The current and proposed number of rooms that contain beds must be clearly
identified so as not to include suites or units. The current and proposed
septic system designs are based on number of bedroom units.
2. How will the proposed suites be used, so that they will not function as
independent bedroom units, that could be rented independently? Will the
suites contain beds or pull out couches? 'If they do, this department
would consider the suite an independent motel unit available for rental.
Possibly the showers could be removed from the suite, as why would a joint
living room area require a shower that is already provided for in the
adjacent bedroom unit.
I would recommend that the Board of Appeals' decision clearly identify the
number of suites, type of furniture, and allowed use, i.e. family area or
sleeping area, kitchenettes and showers.
3. The current septic system for the Blue Water Resort Motel is shown on
several engineered plans. I would recommend a review of the septic system
with a plan showing the asbuilt location and capacity of the septic system
based on the number of motel units and restaurant. Do the current septic
systems meet today's regulations, specifically are they 4 feet above
ground water and proper separating distances between septic systems?
The current engineered plans show reserve septic areas which are to be
used for septic repairs in the future. These septic reserve areas cannot
be used for future septic areas. New septic areas must also show reserve
leaching areas.
Any future additions of bedroom units must meet Title V per engineered
plan with no variances, unless approved by the Board of Health.
Therefore, it is important that the applicant show the proposed and any
future septic systems in relationship to any planned additions.

Recycled
L] Paper
APPEAL #3149 AND #3154 PAGE 2 OF 3
4. Any additions or renovations (bedroom units) that increase the sewage flow
will require compliance with the Board of Health regulation of sewage
flows more than 2,000 gallons/day. This regulation requires an
environmental study to determine any effects on ground water, wetlands or
other surface waters. The applicant has inquired if the redistribution of
motel units/bedrooms (no increase in units) between Blue Water Resort and
Edge of the Sea Motels will require compliance with the regulation.
A Board of Health hearing will be scheduled after a determination has been
made by the Board of Appeals in regards to what changes will be allowed.
5. The Health Department issues an innholder's license for 82 units to the
Blue Water Resort. This does not include the duplex located across the
street at 124 Wilfin Road.
6. The duplex located at 124 Wilfin Road, as of November 1994, is registered
with the Health Department as rental units in accordance with the town's
Chapter 108 Rental Bylaw. Currently the duplex at 124 Wilfin Road is
unoccupied. A Health Department inspection will be performed after
receipt of the 1995 Rental Registration and prior to occupancy.
7. This department currently issues a food service and common victualler
license to the Blue Water Resort as follows:
153 seats - Main Dining Room
26 seats - Dining Room 1
26 seats - Dining Room 2
8. This department performed a food establishment inspection in July 1993.
9. This department issues an indoor and outdoor swimming pool license for the
Blue Water Resort. The establishment is in compliance with the Board of
Health swimming pool regulations, that require at least two personnel on
the premises to have C.P.R. , first aid and water safety. The outdoor pool
was inspected on May 6, 1994. The indoor pool was inspected
January 11, 1994.
10. The house located at 120 Wilfin Road was a private residence owned by the
Lippman family since 1948. The Davenport Realty Company purchased the
property this summer. A complaint was received by this department about a
possible rental unit. The Health Department worked with Davenport Realty
to correct several housing violations. The property is currently
registered with the department as a rental unit, however, it has been
unoccupied since approximately Columbus Day weekend. Further renovations
are planned to bring the rental unit in compliance with the state housing
code prior to the Health Department's licensure and inspection for the
1995 season.
a. August 5, 1994 - Received complaint from Howard Wensley regarding
house occupied by employees of Blue Water.
b. August 8, 1994 - Letter to Blue Water Resort Motel regarding rental
registration and inspection.
APPEAL #3149 AND #3154 PAGE 3 OF 3
c. August 12, 1994 - Telephone call from Paul McBride of Blue Water
Resort Motel regarding rental inspection.
d. August 30, 1994 - Meeting at Health Department office with
Paul McBride. New front steps installed; new kitchen sink installed;
screens on house to be completed by Friday; two female tenants, who
were employees of Blue Water Resort, to vacate mid-October; house to
be further renovated prior to occupancy for 1995, including new
Title V septic system.
e. November 2, 1994 - Memo to Paul McBride regarding rental registration.
