Yarmouth Appeals#: 5240 Ch 40B Comprehensive Permit Decision Irrigation Condition DATE: October 30, 2026 DEPT of COMMUNITY DEVELOPMENT RECEIVED OCT 3 0 2026 YF•ftFO{J' H MARD OF kS On behalf of the Affordable Housing Trust, I am writing to the Zoning Board of Appeals in response to a letter the Trust received from Habitat for Humanity of Cape Cod. The letter is regarding the recent Ch4013 Comprehensive Permit issued for the six (6) affordable homes at 1121 B Rt 28, South Yarmouth. It is our understanding that Habitat does not accept the permit's condition requiring irrigation in the development. The Trust discussed this matter on October 27, 2026, and support Habitat's request that the irrigation condition be removed from the Ch 40B decision. We would rather that the Board entertain an alternative condition to address its concerns. As you know, the Trust created the opportunity for this development by assisting Habitat to purchase the property. Since 2022, the Trust has met with Habitat multiple times to review the development plans and are satisfied with the proposed site design, fencing, and landscaping. Considering the choice of native and drought -resistant landscaping for this development, the added cost of irrigation to the project and future low-income homeowners, the prolonged drought in Yarmouth, and the current water conservation efforts by the Town, the Trust finds the irrigation condition is inconsistent with local concerns and Town efforts, and request that the condition is removed. We have contacted Town Counsel to gauge if is there is an alternate condition which would address concerns regarding the overall appearance and upkeep of the development and be in line with local concerns and efforts. i understand with expedited action, the Zoning Board of Appeals can reconsider the condition. Hopefully this matter will be placed on an upcoming agenda for discussion.
