Dear Mr. Poyant,
1 have been retained by Mr. Young to dispute the finding of a "River" occurring at 71
Arrowhead Dr., Yarmouth Port MA.
During the period of February 14,16,18, and 19th 2023, I observed a dry ditch
behind Mr. Young's property deemed to be a "River' by the DEP. 1 took photographs
each day depicting a man made ditch without any water present during a non -
drought period.
I also contacted the Town of Yarmouth Water Department to discuss public
drinking water wells in the vicinity of Mr. Young's property. Mr. Young's property is
within a "Zone 2" area as mapped by the Town of Yarmouth. The ditch is
approximately.25 miles southeast from the actual wellhead. White's Brook occurs
approximately 600 feet northwest from the wellhead. White's brook is flowing year
round and is presently at % bank full. The ditch however, at a distance of
approximately a quarter mile from the wellhead is dry and has been dry for many
years, (Personal observations by me as Yarmouth Conservation Administrator for
30 Years). The dry ditch is not monitored by Cape Cod Mosquito Control, (GCMG). I
believe you have received CCMC correspondence to that effect

In conclusion, I firmly believe that this dry man made ditch is not a "perennial
stream".
