Project Summary
The applicant proposes to construct a new 9,900 square foot building at this site in the B3 Business District and the
Aquifer Protection District (APD). This is a previously undeveloped site. According to the site plan, the applicant
proposes to use 700 square feet of the building for a realtor's office, which is use 14 in the 202.5 Use Regulation Table,
and for a code G1 wholesale facility for the storage and sale of kitchen and bath appliances, etc. The Building
Commissioner must determine whether the retail sales component is a major or minor part of this proposed use. If a
major part, then the use might better be interpreted to be an H retail trade use, which are not allowed in the B3 zone
without a Variance first being granted by the Board of Appeals.
This proposed 14 realty office use is allowed in the B3 zone and in the APD. The proposed G1 wholesale facility use is
allowed in the 53 zone, subject to footnote 9 (provided that such use is not injurious...). The G1 use, however, requires a
Special Permit from the Board of Appeals in the APD. Alternatively, if the Building Commissioner and Health Agent find
that the proposed use poses no substantial risk to the pubic drinking water supply, a Determination of Non-Applicability
may be made, as outlined in Bylaw section 406.5.1.1.
Comments
Building: (1)Based on the site plan dated January 6, 2006 relief in the forth of variances are required: Section 301.4.1-
parking in front of the building, Section 301.4.3-travel lanes less than 10 feet in width, and a driveway exceeding 24 feet
n width and Section 301.4.5 for a buffer less than 20 feet in width. (2)A special permit or exemption shall be sought from
he APD requirements. (3)AII construction shall comply with all applicable requirements of 780CMR and 521CMR,
ncluding Construction Control. (4)The final construction plans shall denote the Construction Type and Use Group for
JBuilding Code purposes. (5)The Building & Mechanical Code Plan Review fortes shall be completed by the designe3rs
[provided at Site Plan Review). (6)A narrative describing the proposed use shall be submitted to address the retail
component aspect.
Communitv Develooment
Conservation:
Design Review: Roof pitch is unattractive and would prefer it to be higher. Lot shape is difficult to allow parking in proper
locations but probably could be done if building was laid out differently and/or smaller. 3 in parking lot trees not shown.
Buffers should retain existing tree vegetation and screening around entire site. Front parking lot with oversize curb cut not
desirable and needs relief. Some different front facial design and roof line suggested (diagrams given to petitioner) to
break up the nearly 100 foot long facade. Shingling is good plus front windows OK but suggest proper spacing for better
architectural look.
Enaineerinq: Relief required for parking in front of building (301.4.1). Relief required for less than 20' wide driveway in
back (301.4.3). Relief required for large curb opening on Aaron's way (301.4.3). Relief required for parking spaces that
require backing into a public way Drainage calculations and an operation and maintenance plan will be required.

sq. ft. and the parking demand depicts a total of 9,400 sq. ft. This difference shall be accounted for in the site plan
submitted for permit purposes. Per section 301.3.1, the Site Plan Review Team has voted unanimously to allow the 4
parking spaces to the west of the proposed building to remain uncenstructed unless and/or until the Building
Commissioner determines that they are required. At that time, the applicant would need to petition for a Variance from the
Board of Appeals for a nonconforming travel way (less than 20 feet wide) to those parking spaces. Off site parking, per
Bylaw section 3014.2 may used in lieu of this parking requirement.

shown on the applicant's plan. It is this reviewers opinion that, due to the shape of the lot, the proposed building is too
large for the site and should be scaled-down.
Water Concerned about parking in the water easement and repair to water main and services in that easement with the
proposed pavement. The applicant should refer to the Water Division Superintendent. The domestic water service must
be sleeved.

variances within the next few days.

The Kitchen and Bath Gallery is a design center for the use of
contractors, builders and their customers. It is a fully staffed design center
that assists homeowners and builders specify materials such as fixtures,
faucets and kitchen cabinets that will be purchased later on account and
installed by licensed contractors.
The Kitchen and Bath Gallery design service can take several
appointments and meetings to accomplish the goals of product selection and
design. It establishes the materials required on any jobsrtes and has those
materials delivered directly by the vendor or through affiliated companies.
The goal is to satisfy the demands of the building community through
the selection process on materials that are normally discussed in the custom
home arena as "allowance" items. Unlike retail sales there are no goods
transferred to the consumer at this facility, and billing can be directed to
contractors or builders as the case warrants.
