Dear Attorney Brust:
I have reviewed Special Permit #39b2, for 6 Willow Lane in South Yarmouth, in order to
reply to yoc�r recxnt ketter. The bylaw aad decision maIIdated that tlre owner "shalt ocxupy, as
their primary residence" the main house. You asked if tLis would completely preclude Mr.
Maztin from occasionally rerning lus house wlvle he was away on a trip, or house-swapping as
part of a vacation or trip. The issue is not addressed in the bylaw and to my knowledge has
� never come up before the Bom�d of Appeats. Imtiatly, snch determinstioas should be made by
- the Building Commissioner, w6o is the Zoning Enforcement Officar. My personal opinion is
that an occasional occupancy of the house by ot6ers, such as reming it for a week whea the
owner is away on vacatioq would not violate the bylaw or decision. However, reming it
repeatedtY> or as a busiaess venture(rath�then for the comenience of tl�owner)would vio2ate
the decision and bytaw. It muat, in any event, remain occupied predominantly by the owner as
ttis principal resideace. I can't give you an opimon as to how many remats p6r yeaz would be
allowed, but any recurring pattern of rental would certainly be suspect and justify further
inquiries by the Comnrissioner.

Dear Ms.LaFrance:
' This office represents J. Scott Martin, Trustee of JSM Realty Trust in connection
with the above-referenced matter. Prior to eommencing any work in connection with the
� Grant af Special Permit,my client wishes to clarify the tarnzs of one of the canditions set
forth in the Decisian.
The fourth conditian set forth in the Decision states:
"4. As reqaired by the bylaw the owners primary residence within the main house,
and the residence of qualified famiiy member in the apartment,must there�fter be
maintained,and neither the main house nor the accessory apartmem may be rented fo,ar
aceupied by,non-qualified person under this Special Perrnit"
My client intends to ocoupy the main house as his prirnary residenoe and his
pazents intend to occupy the apartment as one of their residences. There is no question or
issue regarding this requirement
Mr. Martin is cancerned abaut"the outright prohibition of any rental or
accupatias�s by non-qualified persons. In cannectian with his anticipated retirement,my
client would like to travel and at this time would lik$to be able to either enter into a shart
term rental for the main house or house swap with a family in anather part of the country
or in Euro�re.

My property at 751 Willow St.which I have owned for 42 years abuts 8 Willow Ln. S.Y.
� My conceem is that the notarized letter of application to the Board of Appeals represents the
peti6oner as the"owner in residence" . Mr. Martin has not lived at 6 Willow Ln. S.Y. for over 15
• years. During this tlme the property has predominantly been used as yearly and summer rentals.
• A�ut 3 years ago the property was offered for sale by the Davenport Company and then it was
withdrawn when a no buyers�uld be found. It was then renovated and upgraded.
I believe the petitioner should establish residency in Yarmouth before applying for a Family-
Related Accessory apartrnent This would be in keeping with the intent of this bylaw.
