Basement Finnish Playroom/Family room The purpose of my presence before this Board is to seek your concurrence on a life and safety concern with respect to the installation of an escape and rescue opening IAW Sedion R310, EMERGENCY ESCAPE AND RESCUE OPENINGS, (EERO)of the 2009 International Residential Code, R310.1 Emergency escape and rescue required..... See proposed plans submitted with request for approval of subject proposed � plans to the Yarmouth Board of Health Commissioner on 20 April 2015. Yarmouth Building Department has sought and obtained clarification on when an opening of this type is �I "required"and this request is to go beyond the"interpreted" code and install the opening for what I believe is in the best interest of life and safety for my family and in particular my grandchildren who will be using this space as a play area. Additional facts are as follows: I currently only have one means of access from my basement that enters from the garege on the other end of the structure from where 1 propose to install the escape/rescue opening. I do not have a bulk head,walk out basement or entry to the basement from the habitable area upstairs or the ability to install those means of egress due to limited space at the rear of,and interior of my ' home. Notwithstanding, my understanding is that current code does not recognize egress into the garege or the habitual space above as the only means of acceptable escape in the event of a life threating internal systems failure or external natural caused event that could render the current and only escape route to be blocked. � � Without an additional code compliant escape and rescue opening(EERO) in the basement I would be i putting my family in an unnecessary life threating danger due to the existing structure of my home. � The proposed finished space in the basement is purely for the enjoyment of grendchildren and other � family members. In summary,the proposed finished space does not include any bedrooms or is it my intent to construct � bedrooms in the future.Additionally, as laid out, the proposed plan does not indicate internal walls that �' could be considered a bedroom and as proposed,the building code would not allow a permit to be , issued since a bedroom cannot be accessed directly from a garage. � i By virtue of my signature on the Application for Permit, I have attested that the plans/information I submitted are a true and accurate depiction of my intent and will meet or exceed Massachusetts building codes and any interpretations and or instructions from the Yarmouth Building Dept. j Respectfully submitted, John P.
