Licensee proposes the following revisions and restsictions to its ea�isting all alcohol
license.
I. The permitted azea for the consumption,sale ,delivery and storage of alcohol
is to be described in detail as follows: a?own of Yarmouth owned site located
at 62 Highbank Road, South Yazmouth,Massachusetts,known as Bass River
Golf Course containing acreage and improvements described as an 18 hole
golf course with associated toads, lots,restaurant, patio, operations center,
restrooms,maintenance center and maintenance outbuildings and further
described in the Barnstable County Registry of Deeds in Book 843 Page 41 I
and described by the Town Assessar as Map Block 117 and hereinafter
referred to as the"golf course"with the exception of ail areas prohihited by
law including:public and private ways,parking lots and entrance and exit
roads,with tl�e exception of those areas described in Section II below and
described in Attachment#1 and Attachment#2
II The following azeas of the golf course are requested to be excluded from the
"sale"of alcoholic beverages.
a. All azea prohibited by law including public and private ways,parking lots,
and enhance and exit roads,
b. Within 100 feet of any public or private way,
c. Within 100 feet of Golf Course parking]ot or entrance mad,
d. Within 75 feet of the Clubhouse, except as where currently authorized,
and described in Attachment#1 and Attachment#2,
e. Within golf operations center,
f. Within maintenance center,
g. Within maintenance outbuildings,
h. A map of the requested service areas is described in Attachment#I and
Attachment#2.
III. As Demand dictates,the Licensee will be authorized the use of up to two food
and beverage carts to be used for the deiivery and sale of alcoholic beverages
on the golf course excluding the azeas described in Section II, a-h inclusive,
and
a. The style and type of cazt is subject to the approval of the Director of Golf
Operations.
b. B. Licensee will operate the food and beverage cart in such a manner as
not to interfere with the enjoyment of the golf course by the course
patrons.
IV. Storage of alcoholic beverages will be limited to the area described as the
restaurant,storage azea and adjoining basement as described in Attachment
#2. No other storage areas aze requested.
V. No request for additional structures for the sale of alcoholic beverages is
requested.
VI. The Licensee sha11 not pemut the sale,delivery possession of more than two
drinks to any one patron at any time.
VIL The Licensee shall post signs stating"no alcoholic beverages to be pernutted
beyond this poini"in all areas that alcohol is not permitted as specified by the
local licensing authority.
VIII. Licensee, employees and management will be thoroughly trained in all
protocols established by the Town of Yarmouth Golf Course Operations and
Yazmouth Police Departrnent, for the reporting of violations of the Town of
Yannouth's policy regazding possession and/or consumption of alcoho(on the
golf course, entrance roads, lots and licensed premises.
IX. The Licensee shatl not pernut any patron to carry or transport any alcoholic
beverages on or off the grounds of the golf course or parking lot. See Section
VII above.
X, The licensee will ensure that each person employed for the direct handling or
selling of alcoholic beverages is 18 years of age or older. Licensee shall
require all employees who serve aicohol to be current in TIPS training and
upon request will provide evidence to appropriate town officials.
XI. Licensee shali maintain all insurance coverage as specifically required by
contract, including general liability and liquor.
XII. Licensee shall be vigilant during the golfing season to avoid violations of
Massachusetts General Laws Chapter 138 and 69 and ensure that no alcoholic
beverage is sold or delivered on any licensed premise to an intoxicated person.
Caze will also be taken to avoid violations of Massachusetts General Laws
Chapter 138 and 34 by ensuring that not only no one makes a"sale or delivery
of any alcoholic beverage or alcohol to any person under 21 years of age,
either for his own use or for the use of his parent or any other person"but also
that no one fumishes,and knowingly or intentionally supplies,gives or
provides to or allows a person under 21 yeazs of age to possess alcoholic '
beverages on premises or property leased or controlled by the licensee.
XIII. Licensee does not request any additional permazient shvctures for the sale of
alcoholic beverages other than those now in existence and described in
Attachment#I and Attachment#2.
