The plumbing code does not regulate"portable toilets", in an effort to accommodate the users of the facility accommodations for temporary toilets are recommended. In reference to the bullet items contained in the email below: 1)The"ratio of 2 female designated bathrooms for every male bathroom" is inaccurate. 2) Portable "ADA"toilets are designed to comply with the accessibility requirements and shouid be placed on a leve� surface and would not require additional ramps. 3)Yarmouth Heaith Department is currentiy researching cleaning and sanitizing requirements for portabie toilets? With the intent of clarification, 780 CMR the building code regulates the use of the buiiding, 248 CMR the plumbing code regulates the required fixtures when plumbing is installed, 521 CMR the handicap code regulates the Massachusetts accessibility requirements, ADA is the federal authority governing accessibility. With the intent of the plumbing code, it is suggested that an ADA compliant portable toilet, a portable toilet designated "female", and a portabie toilet designated "male" be provided to temporarily accommodate the visitors during the bathroom renovations. We are all in agreement that the restaurant will not be opened until the bathroom renovations are completed and the bathrooms can be re-opened. In the interim, we intend to have the golf course open for business. Mr. Niall Hopkins has suggested to me that the code requires the following. • A ratio of 2 female designated bathrooms for every male bathroom; • Ramps to access the portable toilets; • Toilets must be cleaned daily for public use (as opposed to use weekly for use by workers at a construction site) Mr. Hopkins indicated he had spoken with a Ted Hopkins (no relation)at the Architectural Access Board and that we could expect to hear ftom that agency regarding a complaint that he filed. We seek your guidance as to what measures the Town must take to meet applicable codes for a temporary situation pending completion of construction in late May or June. Bruce Murphy has indicated that if the restaurant is closed there are no applicable health codes. Please feel free to contact Jim directly for any clarification of details. His concern centers around the provision of bathrooms at the Bass River Golf Course. He indicated he had contacted a state health agency as well. I understand you may have looked into the matter. Could you please let us know your thoughts as to what additionai measures may need to be taken so that the Town can continue to operate the goif course while the permanent accessible bathroom facilities are temporarily out of service?We do not have a definite timeframe for completing the bathroom work but it could be over a month before the work is completed. As you may know, we now have in place a permanent unisex bathroom on the lower level of the clubhouse and portable facilities adjacent to the permanent bathrooms which are temporarily closed. In addition, there are portable toilets on the golf course as is the customary practice. Thank you, Peter Peter K.
