I, Bruce Murphy, do depose and state the following:
1. I am the Director of Health for the Town of Yarmouth.
2. As of January 25,2010 there is no"Permit To Operate A Food Establishment"for the
Bass River Grille, located at 62 Highbank Road, South Yarmouth, MA.
3. Applications for 2010 Permits were mailed out to Food Establishments in the end of
October to the first week of November 2009. No Application was submitted for the
Bass River Grille.
4. Past Applications for the years 2008 & 2009 were received as noted from W illiam or
Bill Moran of 16 Grayhampton Road, West Yarmouth.
5. The State Regulation, 105 CMR 590 "Minimum Sanitation Standards For Food
Establishments State Sanitary Code, Article X", section 590.012 Permit to Operate
(This section regulates Permitting).

For Bass River Grille, located at 62 Highbank Road, South Yazmouth, MA.
Applications for 2010 Permits were mailed out to Food Establishments in the end of
October to the first week of November 2009.No Appiication was submitted for the above
Past Applications for the years 2008 &2009 were received as noted from William or Bill
