FYI —Bruce and Mary Alice, in order for a letter to be deemed legally served under our food concession contract,
it must be either hand delivered or sent via certified mail. I suggest that hand delivery combined with email to
cover all basis without undue expense and delay.

RE: Patio & Seating Capacity of Bass River Grille
Dear Mr. Moran:
Thank you for meeting with Health Director Bruce Murphy, Jim Armentrout, Ron
Hewins and me on September 5, 2008. This letter confirms the outcome of our
conversation and provides additional information on related subjects. Based upon the
information submitted as part of your application for liquor and entertainment licenses,
you are presently permitted to have up to 62 seats in the restaurant without entertainment
and 46 seats with entertainment. The number of indoor seats could be increased upon
submission of a revised floor plan. Until such rime as the septic system is upgraded, the
total number of indoor and outdoor seats for which food and beverage service can be
provided will be limited to 73 which is historical number of seats pemritted indoors at the
Bass River Clubhouse dining area.
With respect to outdoor seating, you may have as many seats as can reasonably and
safely be placed within the confines of the designated pario area provided that these seats
are used only as a "take-ouY' azea -- meaning that food and beverages may be consumed
in this area but "waitress service" cannot be provided. Presently, the outdoor patio area is
defined by stakes and ropes. As you know, the Town will be installing a concrete patio
with a rail system. On the day of our meeting, Jim Armentrout showed you the
approximate configuration of the patio to be installed and you indicated it was agreeable
to you. The outdoor patio available for your use under the Bass River Food Services
Concession Agreement will be detailed in future conespondence after construction is
complete. This area will be several times larger than the 200 squaze feet patio provided
for in the definition of the premises in the Bass River Food Services Concession
Agreement bid specifications.

The Health Director has noted in sepazate correspondence to you that the Boazd of Health
is reviewing outdoor food service seating and take-out azeas with respect to septic system
requirements. It is possible that the requirements for all such take-out azeas in Yarmouth
may be changed in the future. For this reason, and because the eacisting septic system is
not perfornring well, Director of Crolf Jim Armentrout is accelerating his plans to upgrade
the septic system. We will keep you informed as we learn more about the scope and
timeline for this septic upgrade.

Deaz Mr. Moran,
This letter is a summary of our meeting from Friday, September 5, 2008, in regards to the seating
allowance within the Bass River Golf restaurant. The current approved seating per the floor plan
you submitted shows an indoor seating of forty-six (46) with entertainment, and siacty-two (62)
without entertainment. The outside seating area will be for take-out only, and is not limited to
the previous twenty-four (24) seats. This outdoor seating area is for take-out only, with no
waitress service. A sign should be placed designating this azea as take-out only. It is my
understanding that the take-out will be confined to an area defined by the Golf Director. This
take-out azea, which is currenUy under constructioq will be on the concrete azea outside the
restaurant.
It is possible that a limited outdoor service area could be considered. Based on the past historical
inside occupancy of seventy-three (73) seats, the difference from the currently approved inside
seating up to the historic number could be located in an area that is separated from the take-out
and smoking area. A seating floor plan must be submitted for prior approval before any changes
in the outside seating is allowed.
Any outdoor cooking on the grill is limited to ten (10) events per calendar yeaz. The outdoor
cooking will be under the direction of your food safety certified employee. The coolang woutd
be limited to hamburgers, hotdogs, steak/steak tips, and pre-cooked sausage. Any other menu
item would need prior approval by the Health Department.
As I mentioned at the meeting, the Boazd of Health is reviewing outdoor food service seating and
take-out areas, and whether consideration must include septic system capacity.
