Johnson-Staub Page 1 of 1 Murphy, Bruce From: Johnson-Staub, Peter Sent: Friday,August 29, 2008 9:48 AM To: Lawton, Robert; Murphy, Bruce Cc: Armentrout, Jim Subject: RE: Bass River Grille To clarify the Town's obligations to Mr. Moran as the Vendor pursuant to the Bass River Food and Beverage Concession Bid, the Premise is described in the bid spec as follows: "Premises consist of approximately 1,100 sq. ft. of floor space in the Bass River Golf Course Clubhouse which space includes a kitchen and dining area, and an approximately 200 square foot patio area where drinks may be consumed but not served." Mr. Moran has suggested that he is entitled to a larger patio because Jim Armentrout verbally agreed to a larger patio after bids were submitted and opened but before Mr. Moran signed his contract. He also notes that he submitted a floor plan for his liquor and entertainment license which is lazger than the origina1200 sq. ft. patio and that by issuing the licenses the Town has accepted that plan. I do not believe that the developments after bids were opened affect what the Vendor is entitled to under the food concession bid. I do not think the floor plan is drawn to scale or labeled to show squaze footage (which undermines the argument that"the Town" approved the larger patio) but certainly we should be mindful of prior approvals so that the Town's actions aze not perceived to be inconsistent. It is of course possible that one agency might sign off on a plan while another agency might not. Peter Peter K. He states that you have determined that the occupancy of the outside, so called caf� seating, is based upon a 10 x 20 area. Mr. Moran states that the area was larger, through changes made by the Town and that is the area he would occupy through is contract with the Town. Can you tell me how many peopie you are going to allow for the caf� seating at the Bass River Grille and on what basis you make the decision. It is my understanding that the area the Town assigned to the Bass River Grille was within a fenced in area just outside the restaurant which cn be defined by Jim A. Bob L. 8/29/2008
