He should have a site plan from when he applied for his liquor permit. The out door seating area for"Cafes" must be readily cleanable, such has concrete, brick or tile, and NOT Shells. This area seems to be expanding without town review and comments. Would the seating or dinning area be increased? Would be best if you can into health office and we could further discuss. This question concerns the outside area between the concrete patio and the river. It is an area of some 1200 square feet of lawn currently with some patio tables and Adirondack chairs. The maintenance of the grass is problematic with the traffic, and Mr. Moran has asked if it would be permissible to utilize shells as a ground cover to keep the area from turning into mud, while still utilizing it as an overflow for the restaurant. The aggregate number of seats, inside and outside, remains below the permitted level. Can you give me some guidance in this matter? So far, I have been able to confirm that the Conservation Administrator, Brad Hall, has determined that all areas where Jim Armentrout agreed to have concrete installed are within 100 feet of a wetland and therefore require Conservation Commission (CC)approval before installation. That includes both the area that the Town is paying for and the patio extension that you have volunteered to pay for. Mr. Hall also stated that an area where concrete was installed by the Town earlier this year is also within the wetland and should not have been done without CC approval. If an as-buiit plan can be submitted in time, Mr. Hall will attempt to put the matter (including the area already installed by the Town)on the CC agenda for September 4"'. Mr. Hall has advised that he cannot recommend that concrete be installed within 8 feet of the weUand which would be the result if the patio were installed as planned. However, it may be possible to install shells or stone in the desired locatlon. Mr. Armentrout will check with the Health Division to determine whether or not such installation would be permissible with respect to health regulations. It is my understanding that the only area where sod has been removed and forms installed is the area that the Town is paying for. This work must be ceased pending CC action. It cannot be retumed to a prior state in the interim per Mr. Hall. It is my understanding that the concrete truck was not scheduled for today as the site work had not yet been completed. The Town, Bob Carlson, did pull a building permit for window replacements and other work at the clubhouse this spring. Initially, a deck or patio was included in the permit but it was later removed from the permit when it became evident that a building permit is not needed for a concrete patio. There are no other areas that Jim Armentrout or Brad Hall can recall where an impervious material was installed within 100 feet of the wetland at the Bass River Golf Course in the last year or two. Mr. Armentrout will be in touch with you later this week with an update on how we might proceed with improvements after he has heard back from the Health Division. Respectfully, Peter Peter K.
