Murphy, MPH Health Director RE: 311 Route 28, West Yarmouth Fortner Retail Tobacco Store Date: January 22, 2003 A new septic system was installed on August 21, 2000 at the building located at 311 Route 28 for an existing retail structure with a proposed septic flow of 239 gallons per day. Several variances were granted including: 1. Septic leaching lceation is 70 feet to a drainage pipe that empties into Lewis Pond(a vuiance of 30 feet from the Board of Health required 100 feet). 2. Leaching facility is four feet above groundwater rather than the required five feet. The tenant next door at Bagels and Beyond, Jason Cazvalho, is requesting to relocate his current 18 seat bagel shop to the location at 311 Route 28. However, his current operation is based upon 20 gallons per day for each of the 18 seats for a total flow of 360 gallons per day. This current flow exceeds the septic capacity of the proposed site. The wrsent septic system at 311 Route 28 of 239 gallons per day divided by 20 gallons per seat would allow for 12 seats. The request is to allow an increase in seats to 19 based upon the following: 1. A percent of the water usage is consumed within the production of the bagels and coffee. 2. All paper service. 3. No cooking, stove or fryolators. 4. Restaurant is only open for breakfast and lunch (approximately 6:30 AM to 2:00 PM). The water usage for the current Bagels and Beyond at 327 Route 28 for 19 seats is: 1999—2000 88,000 gallons 2000—2001 93,000 gallons 2001 —2002 112,000 gallons Bagels and Beyond is open 363 days a yeaz(closed Thanksgiving and Christmas). The discussion for the Board is whether there are unique circumstances in this type of operation and with certain conditions that would allow the number of seats to be increased from the allowed 12 to a proposed 19 seats.
