PBILIP 8 MA@7VSON xeP: 14-813-OF PROTECTIVE CUSTODY REPORT FROM: 14667-AR On May 28,2014,I was assigned to the West sector of town in marked unit Jl l for the 412 shift. At 2030hrs I was Eastbound on Route 28 neaz Becteapocka�e store.My attention was drawn to a tall man stumbimg on the sidewalk in from of the Days Inu.He was taD,pale,with short hair and wearing a geen hoodie. While in the Days 3nn driveway he st�bled toward Route 28 and stopped just short of the travel portion of the road.He continued to stumble as I pulled over and got out of the cmiser. I engaged the man in convetsation.I�I'is eyes were extremely bloodshot and glassy and he swayed from side to side as we talked.His speech was sl�ed,and there was an odor of alcoholic beverage coming from his breath. I asked if he had been drinkmg.He said that he had.In his sweatshirt pocket he had a paper bag with a 375m1 bottle of Gordons 100 proof vodka. Based on my observations,I conclnded that the msn was extremely drunk. The man said he was staying at the motel up the stree�which I took to mean the Sepnessett MoteL He said he was staying fheie alone. Concemed tbat he was likely to fall or fall into the street if left alone,I placed him m protecrive custody. I handcuffed him behind Iris back,double locldng the cuffs.He was compliant throughoirt.During this time Deputy Chief Xiazhos stopped to assist The man said he was diabetic.I asked him if he was having a diabetic probiem now.He said he was not I asked if it was just the alcohol that was affecting him. He said yes. I placed the man,identified as�m the back seat of my cmiser and transported}vm to YPD where he was booked by Sgt Boghdan. Sgt Boghdan administered a PBT test wluch produced a reading of 341%BAC at 2050hrs. I advised Sgt Boghdan of�medical condition. During the booking inventory I remov�a sales slip for"Gordon's Vodka 375"from the right pocket of the man's hoodie.The slip was from Becker's Package Store bearing a time stamp of 8:2739,about three minut�before I called in the incident Eacamination of the Gordon's Vodka bottle indicates tbat the seal is not broken. PHILIP 8 �fA@NSON xeE: 14-813-OF FOLLOW UP AT BECKER'S PACKAGE STORE At approzimately 2I05 hrs I went to Becker's package store. The two employees on duty were Tracy Ennes and Jovita Delorey.Ms Ennes said that she was the one primarily waitimg on customers. I asked Ennes who was designated as "Cashier 6". She said all the sales were iung up as Cashier 6.I then described and asked if she sold a 375 of Gordon's Vodka to him.First she said"he sounds familiar" and then she had sold the vodka to him. I told Ms. Ennes tLat I had seen bim stumbling nearby,that he was exuemely druuk;and that his blood alcohol was 4 times the legal limit for driving.Ms E�es said that when he came into the liquor store he was not stumbling and his speech was clear. She said he seemed ok I then asked who was in charge of the store.Ms Ennes indicated that Ms Delorey was in charge,as she had been worldng there longer. Ms Ennes asked what was going to happen. I told her that sale of alcohol to an intoxicated person is a crime,but is someliwes dealt with as a license issue. I advised that I would docimment the event and pass it along to my superiors to determine a course of action. Ttuoughout our inteiaction Ms.Ennes was cooperative and forthcoming.
