Re: Tobacco Sales Compliance Check
Location: 528 Buck lsland Road, West Yarmouth
Dear Yarmouth Merchant,
The Cape Cod Tobacco Control Program, in collaboration with the Yatmouth Health Departrnent,
has recently completed a compliance check to determine if minors (anyone under the age of 18)
could purchase tobacco products&om your establishment.
Minors were able to purcLase tobacco in your store during a compGance check on t6e
afteruoon of November 20, 2002. (1'ime - 4:25 p.m.; Employee was male, spproaimately 50
years of age.)
Minors were sent into thirtv-eight(38)Yazmouth establishments licensed to sell cigarettes to attempt
purchases. If the clerk asked the minors their age or if the tobacco was for them, the mmors told
the truth. It is against Massachusetts Law and the Yannouth Board of Health Regulation for anyone
to sell tobacco products to people under the age of eighteen.
Please be advised tivs is your third violation. (Thepast five compliance checks were December 20,
2001, October 11:2001, July 24, 2001, June 7, 2007, and February 22;Z001. Of these compliance
checks,the violahons for your establishment were on June 7,2001 and Feb 22,2001.) You are
hereby ordered to pay a fine of$200.00 as required by the Board of H�th Tobacco Control
Regulation, Section IX. You must also appear at a Board of Health hearing scheduled for
Monday,December 16,2002 at 4:15 p.m. at the Yazmouth Town Hall hearing room. At the hearing,
the Boazd of Health will determine iY�yout tobacco license should be suspended,revoked,restricted . _
or other penalties assessed. You or a representative must appear at this hearing.
Please deliver the fine payment to the Health Depaztment prior to the Board of Health hearing.
Please make your check payable to the Town of Yumouth.
For your information, minors were successful in purchasing cigarettes at two out of thirty-eight
Yazmouth establishments wlvch sell tobacco products.
