He said that he has dispositions from Ed Cusik, Ralph Lincoln and Tom Roche all admitting that tickets are sold to the general public which includes a Clam Bake and all you can drink beer, from kegs, and wine. These tickets are also sold for commissioning and decommissioning of boats. Atty. Robertson offered copies ofthe disposition. Once I got off the phone with Doug, I called Mr. Roche to find out from him his side. I told Mr. Roche that copies of the dispositions were going to be given to the Town. After hearing that, Mr. Roche stated that the club does in fact offer beer and wine as part of the ticket which is sold to the general public. And the beer and wine is not monitored but available on a good faith basis. I mentioned to Mr. Roche that the current sale of tickets offering clam bakes with alcohol requires a liquor license. Mr. Roche said that he would have his secretary stop by and see Linda to get the necessary paperwork to begin the process of getting a Beer and Wine Club license and the Club will in fact cease all service and consumption of alcohol on the premise until such license is approved. Mr. Roche will be sending a letter/email, to either Bob or me, confirming the cease of service and consumption as well as beginning the application for approval of the use. I talked to Linda and she is getting all the paperwork ready. Jim Brandolini has reviewed the property plans and has given an occupancy of i6c, (email below) with a seating of i5o from BOH. The Assessors records reflect the structure in question was construced in 1940 2. I flnd that on October 17, 1963, via petition No. 646, the Board of Appeals granted reiief that permitted a change of use from a "Sailing Village School" to Bass River Yacht Club. This decision included the provision "the yacht club would use the premies at times in the evening" 3. I find no proposed or set occupancy load. 4. A floor plan depicting the interior and outdoor patio dimensions was provided to me on March 19, 2009. Based on this pian and using the formula set forth in 780CMR, Section 1004.1.1�ntitled Maximum Floor Area Allowances per Occupant(for tables and chairs), I have determined the maximum allowabie occupancy for the Lounge and Dinning Areas for a Table&Chair arrangement would be 125. The outdoor door patio could seat, using the same formula 39. (Total 164). 5. The Health department has set a limit of 150 based on their regulatory authority. Doug talked to Linda Hill to confirm that they do not have a Club license or a special one day license. I checked with Bruce Murphy and they do have a Non-profit Food service license for allowed seating of i5o. Building/Fire Dept is checking the room occupancy. Doug mentioned to me that they are including a drink in the price for a dinner on top of having a bartender (which I don't know if there is an open bar available or not). That would mean that they need to have a license.
