Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of property required by law, and to the public by posting notice of the hearing and publishing in The Register,the hearing opened and held on the date stated above. The Petitioner is the Yarmouth Village Condominium Association, the organization of unit owners of the Yarmouth Village Condominium (the "Condominium") located at 135-136 South Shore Drive, Yarmouth, MA. The Petitioner seeks to amend the Special Permit Decision filed with the Town Clerk on August 3, 1984, Petition No. 2090, (the "Decision"), which Decision is filed with the Barnstable Registry District of the Land Court as Document No. 344967, and noted on Master Certificate 98253,and Certificate of Title No.C166. Specifically, the Petitioner seeks to amend Condition (2) of the Decision pertaining to the total number of units allowed at the Condominium in order to clarify that some units actually consist of two(2)dwelling units,but are defined as one unit in the Condominium documents. A member of the Board of Managers of the Yarmouth Village Condominium Association appeared, as did the Petitioner's Attorney Matthew W. Gaines. The presentation by Petitioner and its counsel explained in detail the situation which led them to seek an amendment to the Decision. The situation is as follows: Pursuant to the Master Deed of the Condominium, the Condominium consists of 39 units, as required by Condition (2)of the Decision. However, seven of the units (Units 1, 7, 10, 11, 13, 23, and 32) at the Condominium are actually set up as two separate dwelling units. The Petitioner noted that these seven units have existed in their current layout since the creation of the Condominium in 1984. The Petitioner presented the original floor plans of the Condominium which depict a dividing wall within each of these seven units such that one side of the unit is completely separate from the other side. The Petitioner noted that while these seven units each contain two separate dwelling units, the units are legally one unit with t Doc: 1,377 ,267 08-27-2019 8 : 17 Page 2 of 4 respect to title and with respect to the Condominium documents. As such,while these seven units may be each considered as two separate dwelling units pursuant to the building code, they are considered as one unit each pursuant to the Condominium and title. Several unit owners of the Condominium submitted correspondence in support of the requested amendment to she Decision. No one spoke in opposition to Petitioner's request. The Board felt that with one condition, the requested amendment to the Decision could be granted. The condition is as follows: Condition (2) of the 1984 Decision be revised to state that "The Condominium shall consist of 39 Units pursuant to the Condominium Master Deed, with parking spaces for 78 vehicles; provided, however, that Units 1,7, 10, 11, 13,23, and 32,which each contain two separate dwelling units are permitted to remain as is,but those Units shall not be subdivided into separate Units or sold separately." The Board expressed that with this condition imposed, the Petitioner had demonstrated that the requested amendment to the Decision could be granted without causing any undue nuisance, hazard or congestion, nor will there be any detriment or harm to the established or future character of the neighborhood or of the Town. With the condition stated above, a Motion was made by Mr. Igoe seconded by Mr. Nickinello, to grant the Petition, on the stated condition to which the Board voted as follows: In Favor: Igoe, DeYoung,Nickinello,Baron,and Britta. Therefore,the Amendment to the Decision was granted on a vote of 5 in favor,0 opposed. No permit shall issue until 20 days from the filing of this decision with the Town Clerk. This decision must be recorded at the Registry of Deeds and a copy forwarded to the Board of Appeals. Appeals from this decision shall be made pursuant to MGL c40A section 17 and must be Sled within 20 days after filing of this notice/decision with the Town Clerk.
