SUBJECT: ZBA Petition Number 4919 Cape Cod Fine Finishes LLC Proposed Wood Finishing Shop 583 Forest Rd., Unit A DATE: October 14, 2021 Background and Proposal Nikolay Danov, owner of Cape Cod Fine Finishes LLC met with Building Commissioner Mark Grylls and me on Sept. 9 regarding his proposal to rent a commercial unit at 583 Forest Rd., Unit A. Mr. Danov explained his overall business operation and the specific operations he proposes to conduct at this location. Cape Cod Fine Finishes conducts residential and commercial, interior and exterior painting along with wood cleaning. At 583 Forest Rd., Unit A, Mr. Danov proposes to: (1) park company vehicles; (2) store hard goods; (3) store a small quantity of latex paint and (4) conduct spray finish application of latex paint to finished carpentry components such as wooden trim and moulding. The proposed location is within the Town's Aquifer Protection District (APD) for the public drinking water supply. Regulatory Items 1) Within the APD the storage of toxic and hazardous materials is limited to normal household quantities per Town Bylaw Section 406.5.2. Cape Cod Fine Finishes proposes to store a maximum of 5 gallons of latex paint. 1 2) The Board of Health (BOH) Regulation "Handling and Storage of Toxic or Hazardous Materials," effective May 2, 1990, has a licensing threshold of 10 gallons. Again, Cape Cod Fine Finishes proposes to store a maximum of 5 gallons of latex paint. The regulation also includes, but is not limited to, 150% volume secondary containment of toxic or hazardous materials. Toxic or Hazardous Materials Delivery Mr. Danov or his associates will purchase the latex paint in container sizes of one -gallon or less and bring it to their commercial unit. Toxic or Hazardous Materials Handling and Storage The latex paint will be stored inside the commercial unit within plastic totes that will serve as secondary containment. Toxic or Hazardous Materials Use The latex paint will be used in spray gun application to finished carpentry components as described above. Paint brushes and rollers will not be used within the commercial unit although they are used at job sites. Equipment Cleaning The spray gun applicators are cleaned by cycling water through the equipment. No brushes or rollers are proposed to be cleaned at this site. Mr. Danov is aware that no painting tools or equipment may be cleaned with resultant waste water discharged to the ground such as would happen if these items were washed in a sink. Toxic or Hazardous Materials Disposal Mr. Danov explained that: 1) The resultant water/paint mix from the spray gun applicator cleaning will be retained in buckets of up to 5 gallons in size. 2) No more than one bucket will be filled at a time. 3) The water/paint mix is hardened using a dedicated hardening compound that solidifies the material. 2 4) Once solidified the waste material is disposed of in the general trash. This is acceptable as the material is not flammable or reactive. 5) Excess paint is given to customers that they can use for touch-up application if needed, therefore no latex paint accumulates. icy
